To help you get the best out of Aphobos CrossFit Fundamentals Course Level 1 and to understand our respective responsibilities to one another, please read the Terms and Conditions below. These are additional or complementary to the Aphobos CrossFit main Terms and Conditions which can be viewed on our website.

1. Your fitness and Warranties

1(a) You warrant that you are in good physical condition and capable of participating in the services provided and are not undergoing any treatment or do not suffer from any condition that would put you in any risk while participating in the services.
1(b) You agree that it is your responsibility to seek competent medical advice regarding any concerns or questions relating to your ability to take part in the services and, where appropriate, inform Aphobos in writing of any conditions.
1(c) You will be asked to fill in and sign an Assessment Form before engaging in any of our services. This Assessment Form will be accepted as a personal statement of your health and fitness condition.

2. Payment of fees

2(a) You agree to pay, in full, by credit or debit card the fees relevant to your Fundamentals course. In order to do so you will be asked to provide the name on the card, long card number, expiry date and billing address. Aphobos CrossFit will not accept payments in cash.
2(b) In order to guarantee your place in the course and chosen dates, payment must be processed and authorized before the start of the course.
2(c) You may change your designated account details upon joining Aphobos CrossFit as a member as long as you provide updated information by the time we set up your membership, including new card details and billing address. *Home address and billing address must be provided if not the same.
2(d) You shall ensure your account can be debited by Aphobos CrossFit. If your payment fails, you will be contacted by a member of staff. Any failure by the applicable financial institution to pay any charge or by you to arrange for payment of fees may result in rescheduling course dates.
2(e) All payments are non-refundable except as provided for in this agreement.

3. Duration

3(a) The Fundamentals Course Level 1 is composed of 4 (four) 1-hour sessions that could be spread throughout the period of 2 weeks. These sessions are progressive and therefore missing a session will prevent you from attending the following ones until the session missed is done. (see Item 5 for Cancellation and Missed session(s)).
3(b) After completion, you will have a period of up to 8 weeks to join as a member. If that time expires you will have to re take your course and pay new fees in place at the time.

4. Facilities and Services

4(a) Aphobos reserves the right to, at any time and reasonable discretion, make changes to the program offered including its timetable. No refunds will be provided.
4(b) In the event that Aphobos CrossFit is required to close its premises before the beginning of your course or during it, you shall be offered to join Virtual Classes, if that is offered at the time. This will not affect your right to finish your Fundamentals Course in person but you understand that Aphobos CrossFit will not provide any refund.

Note: In case of Government guidelines regarding the COVID-19 pandemic, cancellation terms and procedures are still binding in accordance to the provisions set out in our Terms and Conditions. Services and offerings may change in light of Government restrictions and Aphobos CrossFit will do its best to provide an alternative service.

5. Cancellation

5(a) In the event that you have to cancel your course prior to its start, please inform Aphobos CrossFit as soon as possible via email (signup@aphoboscrossfit.com). You may be entitled to a refund providing that you have not used the premises or benefited from any services.

5(b) Once the course has commenced Aphobos CrossFit will not provide any refund. You will still have the right to attend and finish your course within the 8 week period.
5(c) In the event of a no show or cancellation with less than 48 hours notice, Aphobos CrossFit will charge you £35 + vat to reschedule that session (or sessions missed).
5(c) Remember that sessions are agreed and pre-booked by the time you sign up. Any cancellation and rescheduling may not guarantee preferred days and times.

6. Joining as a member

6(a) If at the end of your Fundamentals Level 1 course you decide not to join as a member you will have a period of 8 weeks to change your mind. After that, you will be required to retake the course and pay new fees in place at the time.

7. Data Protection

7(a) During your Fundamentals Course, Aphobos CrossFit may collect personal information about you. Aphobos CrossFit will use this information for the purposes of personalizing the services offered.
7(b) Aphobos CrossFit reserves the right to take photographs of its premises which may include you, provided your inclusion is incidental for press or promotional services.
7(c) Aphobos CrossFit may use photographs/videos on social media.

8. Limitation of Liability

8(a) You agree to assume all risk and responsibility for exceeding your physical limits and release Aphobos from any liability in relation thereto.

9. Force Majeure

9(a) For the purposes of these Terms and Conditions, a Force Majeure event means an event beyond the reasonable control of Aphobos CrossFit, including but not limited to strikes, lock-outs or other industrial disputes (whether involving Aphobos or another party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage compliance with any law or government regulation or direction, accident,
breakdown of plant or equipment, fire, flood, storm, or any other severe weather condition, epidemic or pandemic, lockdowns or default of suppliers or subcontractors.
9(b) Aphobos CrossFit reserves the right to offer alternative services and make reasonable changes in Membership in case of a Force Majeure event, as specified above. This, however, does not affect the Terms and Conditions above or provided in items 5 (Payment of Fees), 6 (Default) and 7 (Cancellation) of our full Terms and Conditions.
9(c) Aphobos shall not be liable to you as a result of any delay or failure to perform its obligations as a result of a Force Majeure event.
